NJ Dad Fatally Stabbed In Front Of Family While Protecting His Son From Alleged Robber
Two boys who were involved in a robbery case are locked up in jail for stabbing 30-year-old Jose Malate as he was stopping them from robbing his 8-year-old of his sneakers.
Facts of the Case
The robbery case happened on Tuesday evening and the offenders are in police custody.
Nineteen-year-old Nasir Day and a 17-year-old male, whose name is not made public because he is a juvenile, are both in jail for the robbery case.
According to Hudson County Prosecutor’s Office, “The man was found in a lifeless state in the doorway of the apartment where he lived.” He died from his wounds at the scene.
Charges
One suspect was taken into custody on Thursday and the other was arrested on Wednesday, have been charged for:
- Murder
- Unlawful possession of a weapon
- Possession of a weapon for an unlawful purpose
- Armed burglary
- Conspiracy to commit the crime
- Felony murder
It is not confirmed if Day has hired a lawyer and entered a plea.
Witness Statements
According to the victim’s sister, Yesenia Malate, her brother died in front of his kids and his girlfriend. She told that he was stabbed as he was attempting to protect his son from being robbed and they tried to steal his sneakers as well earlier that day. She added for her brother, “He was always outgoing, always happy and always trying to help people.”
To help raise Jose’s kids and to fulfill his funeral expenses, a GoFundMe page has been set up by the relatives.
The Hudson County Prosecutor’s Office requested any individual with information of the case to call at (201) 915-1345 to provide details if they had seen what happened on the spot. Anyone with information can also leave an anonymous tip on the Hudson County Prosecutor’s website. The name or any other personal information of the person will not be made public.
